These terms of use govern the use of the mobile application USELY (hereinafter the "App") and the associated services. The provider of the App is:

By downloading, installing or using the App you agree to these terms of use. If you do not agree with these terms, please do not use the App.
1.1 USELY is an application for self-employed professionals, small business owners and small companies for creating quotes, order confirmations and invoices, for capturing expenses and receipts and for supporting day-to-day business organization.
1.2 The App offers features that take German commercial and tax standards into account (e.g. mandatory details under § 14 UStG, small business regulation under § 19 UStG, GoBD principles).
1.3 The App does not constitute tax, legal or accounting advice. It is a technical tool. Responsibility for the substantive and legal correctness of the created documents and their tax treatment lies solely with the user. For binding tax or legal questions, please consult a tax advisor or lawyer.
1.4 The Provider continuously develops the App further. The scope of features may change, be extended or restricted.
2.1 Using the App requires setting up a user account. Truthful and complete information must be provided.
2.2 You are responsible for keeping your access credentials confidential and are liable for all activities carried out through your account. If you suspect misuse, please inform us immediately.
2.3 The user account is not transferable.
3.1 The Provider grants you a simple, non-exclusive, non-transferable and revocable right to use the App in its current version for your own business purposes within the scope of these terms.
3.2 It is not permitted to reverse engineer, decompile, modify, reproduce or distribute the App or parts of it, or to make it accessible to third parties without consent, unless expressly permitted by law.
4.1 Certain features of the App are only available as part of a paid subscription ("USELY Pro"). The free scope of features and the additional features included in the subscription are shown in the App.
4.2 USELY Pro is offered as an auto-renewing subscription, currently in the following variants:
Monthly: 9.99 € per month
Yearly: 89.99 € per year
The applicable prices are displayed in the App before the contract is concluded.
4.3 A free trial period (e.g. 30 days) may be offered to new subscribers. If the subscription is not cancelled during the trial period, it automatically converts into a paid subscription after the trial ends.
4.4 Billing, payment and management of subscriptions take place via your Apple App Store account. The subscription renews automatically for the respective period unless it is cancelled at least 24 hours before the end of the current period. The costs for the renewal are charged to your Apple account within 24 hours before the end of the current period.
4.5 Management and cancellation of the subscription take place via the account settings in the App Store. Cancellation directly through the Provider is not possible, as the contract is processed via Apple.
4.6 Apple's terms of use for the App Store apply in addition.
5.1 You are solely responsible for the accuracy, completeness and legality of the data you enter into the App and the documents you create.
5.2 You undertake not to use the App for unlawful purposes and not to enter content that violates applicable law or the rights of third parties.
5.3 You are responsible for complying with your own tax and commercial retention and documentation obligations. We recommend regularly creating your own backups and exports of your data.
6.1 We strive for the most uninterrupted availability of the App and the associated services possible, but do not owe it. Interruptions may occur, for example due to maintenance work, technical faults or circumstances beyond our control.
6.2 The App uses third-party services (in particular for authentication, data storage and delivery). We assume no responsibility for their availability.
7.1 The Provider is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on an intentional or grossly negligent breach of duty.
7.2 For damages caused by slight negligence, the Provider is only liable in the event of a breach of an essential contractual obligation (cardinal obligation), the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the user may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.
7.3 In all other respects, liability is excluded.
7.4 In particular, the Provider is not liable for tax or legal consequences arising from the use of the App, the documents created or the data entered. The App does not replace professional advice.
7.5 The above limitations of liability do not apply where the Provider is liable under mandatory statutory provisions (e.g. the German Product Liability Act).
8.1 The protection of your data is important to us. Information on the processing of personal data can be found in our privacy policy at: https://www.yg-media.de/en/privacy-policy
9.1 The usage relationship for free use runs for an indefinite period and can be terminated by you at any time by deleting your account.
9.2 Paid subscriptions are governed by section 4.
9.3 The Provider may terminate the usage relationship for good cause, in particular in the event of significant or repeated violations of these terms.
9.4 You can delete your account and the associated data in the App at any time. Upon deletion, your data will be removed in accordance with our privacy policy.
10.1 The Provider reserves the right to change these terms of use with effect for the future, insofar as this is necessary for valid reasons, for example due to changes in the legal situation, technical developments or extensions of the scope of features, and the user is not unreasonably disadvantaged by this.
10.2 We will inform you of significant changes in an appropriate manner.
11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.
11.2 Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions remains unaffected.
